Margins Tax

Paula

Written by Tray Abney, Reno's Chamber Director of Government Relations

The Expensive Margins Tax Battle Ahead

The Nevada Constitution says that when a qualified initiative petition is delivered to the Legislature, it has 40 days to act on that petition.

Today was Day 40 and there was no action taken on the teachers' union margins tax proposal.

That means that you will see it on your ballot in November 2014. It is a statewide question and it will be a very expensive statewide campaign effort to defeat it.
Money spent by The Chamber's PAC and other groups opposing this ballot question could be better spent on our endorsed candidates and other issues. No more whining, it is what it is.

You know by now that Senate Minority Leader Michael Roberson and five of his Republican colleagues have proposed sending a mining tax increase to the voters as an alternative to the margins tax, hoping the former will get more votes than the latter and killing the teachers' effort.

There is a legal question of whether or not the Legislature must actually vote to reject the initiative petition before it can propose an alternative. Does not acting on it count as a rejection? Since no action was taken on the margins tax and none can now be taken, is it too late to propose an alternative?

If an alternative is produced after today, this will be headed to the Supreme Court.
