NLRB expected to adopt Ambush Election Rules
NAE has been reminding employers that the National Labor Relations Board is interested in adopting regulations to accelerate the processing of union representation petitions and reduce the time until the elections. The so-called
Ambush Election Rules would clearly favor unions as it would reduce the time employers would have to campaign before the NLRB election. After a period of public comment, it is expected that the NLRB will in fact adopt these rules as proposed. Even though this NLRB decision is likely to be appealed by business groups, all employers should be preparing their management teams on how to respond to union organizing.
