New Fireworks Law

City Council is Busy Putting Together the Indianola Plan

The State of Iowa recently enacted legislation that made the sale and use of all fireworks legal throughout the State. The legislation, which becomes effective June 1, allows cities to determine what types of fireworks (first and/or second class) can be used within their boundaries and where they can be sold.  This week, the Indianola City Council and Planning and Zoning Commission met to discuss the fireworks issue.

The Planning and Zoning Commission (Commission) reviewed current ordinances that would need updated to accommodate the new state law, allowing the sale of fireworks in Iowa.  It's the Commission's responsibility to recommend who and where fireworks may be sold within the city limits.  The Commission will present a recommendation to the City Council during a public hearing on June 5, 2017.  Businesses interested in this issue, should plan to attend this meeting.

During the City Council meeting, the Council:
1. set a public hearing for June 5th to consider recommendation(s) from the Planning and Zoning Commission on where fireworks can be sold;
2. established a moratorium on the sale of first class fireworks until such time as the Council can complete its review of the Planning and Zoning Commission recommendation; and
3. adopted an ordinance that allows for the use of second class fireworks and prohibits the use of first class fireworks.
