We lost a friend, family man, executive board member and my “Board Daddy” Don Ryan. We lost a son, fiancé and protector, Deputy Ryan Clinkunbroomer. These words only scratch the surface in describing the attributes of these amazing men. We send love and hugs to the Ryan and Clinkunbroomer families and friends. As we process our losses let us remember and be proud of the legacies that these gentlemen left. Let us hug our loved ones and let them know every day that they are important. The Advantages and Disadvantages BACKGROUND ON THE CRIMINAL JUSTICE SYSTEM Introduction The Criminal Justice System has been running for 104 years and throughout this time period many changes have been made for the betterment of the people. The money bail system was developed anywhere from 410-1066 during the Anglo Saxon period to try to solve disputes peacefully. Over time there have been more and more problems with this system causing propositions for change to be made. One of these propositions in Proposition 25, the Zero Bail Policy, that would change the bail system. This website contains information on the positives and negatives of the Zero Bail Policy, what the original system was, what the Zero Bail Policy is, information behind the policy and how to vote. How does the Cash Bail System Work in California? The Cash Bail System is a System that charges criminals a certain amount of money, based on the crime committed, to release criminal suspects before their trials. A suspect would pay a cash bond to be released from jail and receive the money back when returning to court to attend the trials and hearings. Bail was deemed as necessary to ensure the suspect would attend all hearings and trials and return back to court. Whether or not the suspect is deemed not guilty, they will receive their money back. Suspects can also use a Bail Bond Agent but will have to pay interest when paying them back. The superior courts are responsible for setting bail but must follow the Eighth Amendment from the Bill of Rights. This Amendment states, “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.” What is the Zero Bail Policy? The Zero Bail Policy, also known as SB-10 or Proposition 25, is a Policy that eliminates bail for certain suspects in the criminal justice system. The state's cash bail system would be replaced with risk assessments done by superior courts and the state Judicial Council would decide which risk assessments are okay to use. The risk assessments would categorize individuals into three categories, low, medium and high risk, similar to the infraction, misdemeanor and felony categories. Suspects that were deemed to have a low risk of reappearing in court and a low risk of posing a threat would be released and vice versa with high risk. Medium risk can go either way based on the crime. If a cop or prosecutor is completely against a decision to release a suspect they can take the defendant to court and make an argument against their release and the judge will decide.
