By means of Legal Notice 173 of 2026, the Government of Malta has implemented the Pay Transparency Directive in a regulation entitled ‘Equal Pay (Transparency and Reporting) Regulations 2026', which came into force on the 5th June 2026.
The regulations are already in effect, which means that the core obligations - categorisation for establishing work of equal value, employees' right to pay information, and transparency of pay structure criteria are legal requirements for all employers.
Key provisions include demanding timelines for pay gap reporting and pay information request responses, expanded transparency obligations, and extensive enforcement provisions, which will change how litigation in this area is handled. The provisions regarding existing collective agreements and the use of the single-source argument in claims of equal value are of particular interest.
